Abstract

Democracy requires the involvement of people in decision-making, equal rights among citizens, freedom and freedom provided to or preserved and owned by citizens, the existence of an effective representative system, and finally an electoral system that ensures respect for the principle of majority rule. Based on the alignment with democratic principles and requirements and the fulfillment of these democratic election system design criteria, the authors argue that the Pure Open Proportional System is a democratic system. Much more democratic than the Limited Open Proportional System which was originally adopted by Law no. 10 of 2008 before the Decision of the Constitutional Court No.2224 / PUUVI / 2008, Semi-open Proportional System which we used in the 2004 General Election, and Closed Proportional System which we adopted in the 1999 election. Thus, the use of Proportional Open Pure System to hold the General Election of DPR 2009 is the right choice. Although it must be realized however democratic, this system also has its accompanying weaknesses. This is the inevitability of all systems because as we know there is no perfect human creation system in this world. Thus, in the context of the correlation between the electoral system of the House of Representatives and the democratic life in Indonesia, the authors argue that in the era of democratic transition which we still carry out today, the normative-theoretical use of this pure open proportional system is positively correlated with the improvement and progress of Indonesian democracy . This means that the use of this pure open proportional system consistently and consistently will result in a better quality of democratic life practice in Indonesia. It is a democracy within which is ensured and reflects the element of accountability, justice, representation and wider community participation without due diligence. Of course, this requires an integral cooperation, tolerance and understanding of all the components involved in the election whether it be the people, the candidates, political parties, BAWASLU and KPU. Without cooperation, integral tolerance and understanding of all components to implement the Pure Proportional System of Pure Consistent and Consistent may be a gaping discrepancy between the normative reality and empirical facts in the 2009 General Election of the House of Representatives (DPR) 2009.
