This research is related to health care insurance agreement giving rise to rights and obligations of the parties, among others: Askes parties have rights to: a) Have an Askes card, to be served at designated health facilities in accordance with applicable provisions b) Obtain an explanation of rights, obligations and procedures for health services and c) Submitting complaints either orally (telephone or coming directly) or written to PT. Askes (Persero) local. While the obligation to pay premiums and obey all provisions. PT. Askes (Persero) has the right to receive participant premium and obligation to provide the best service for Askes participants. The Hospital (provider) has the right to provide medicines, while the obligation to receive and place the Askes and their families according to the agreement. While the government party has the right to exercise its authority by through the provision of health insurance for civil servants, pensions and their families by cutting 2% salary every month and the obligation to ensure health services are organized with managed care patterns that are quality services with respect to the aspect of cost control in stages accordingly with medical needs. Participants can obtain legal protection that can claim if the rights that should be obtained was ignored. Participants of health insurance can sue the hospital as a Health Service Provider under Article 1365 Civil Code, Law Number 36 Year 2009 on Health and Law No. 8 of 1999 on Consumer Protection, can also claim compensation to PT. Askes (Persero) as the organizing body, then at this time taken over by BPJS.
