Abstract

The increasing movement of people as a result of globalization increases the need for transportation services. However, the high demand for transport services is not currently offset by public transport providers that are able to meet the needs of the community. The importance of transportation is very important, the traffic and road transport must be organized in an integrated national transportation system and able to realize the availability of transportation services in accordance with the level traffic needs and transportation services are orderly, convenient, fast, regular, smooth, also at a cost affordable by the purchasing power of the community. Public transport is a public facility that is often used as a means of supporting transpotation as a means of supporting economic development and community development and industrial growth.For public service providers must consider the safety and comfort of their vehicles used as a means of transport, so that passengers as a service user can be fulfilled all right and right as it should without feeling aggrieved due to the condition of public transportation that is less comfortable and less safeguarding of the passengers themselves. But in reality there are still passengers who are neglected in terms of comfort and safety of passengers as users of public transport services. The existence of the enactment of Law Number 22 Year 2009 is expected to help realize legal certainty for the parties related to the implementation of transportation services, both businessmen, workers and passengers. The problems studied in this research are: (1) form of agreement in land transportation, (2) form of responsibility between service provider to passenger, (3) form of consumer law protection to service provider and passenger. This research uses qualitative method with sociological juridical approach because it emphasizes on the quality and validity of data obtained using primary and secondary legal material. The method used in the collection of legal materials is literature study. The results of the research and discussion show that the lack of awareness of service providers in observing the safety and comfort level passenger.
