Abstract

Sexual crimes toward underage children tend to cause negative impacts on the victims, both physically and mentally, so many of them have prolonged trauma. In response to this, the government issued Peraturan Pemerintah Pengganti Undang Undang Nomor 1 Tahun 2016 replacing Pasal 81 Undang Undang Nomor 23 Tahun 2002 Tentang Perlindungan Anak. In Peraturan Pemerintah Pengganti Undang Undang Nomor 1 Tahun 2016, the chemical castration punishment has been regulated. The application of castration chemical punishment raises the pros and cons in human lives. Chemical castration punishment is considered to have violated human rights. Doctors also refuse to become the executors in the application of this punishment because it contains elements of injuring someone so that its application is prohibited in the world of medicine. This report wants to inform about the application of chemical castration punishment for the actors of sexual crimes against underage children. This final report uses normative methods with a conceptual approach and the legislation. Chemical castration punishment has not been an effective one and has no deterrent effects for the actors of sexual crimes against underage children, so Peraturan Pemerintah Pengganti Undang Undang Nomor 1 Tahun 2016 requires a review.
